2. Agreement to these Terms
By creating an account, starting a trial, purchasing a subscription, or otherwise using gmatpanda.com and related services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
3. The Service
GMAT Panda provides online GMAT Quantitative Reasoning preparation tools, including practice questions, learning materials, feedback, study planning features, and related coaching aids. The Service is educational only.
- We do not guarantee any particular GMAT score, admission outcome, or result.
- We are not affiliated with, endorsed by, or sponsored by GMAC (Graduate Management Admission Council) or the official GMAT exam, except where we expressly state a specific sponsorship or partnership.
- Content, features, and availability may change as we improve the Service.
4. Accounts and acceptable use
You must provide accurate account information and keep your login details secure. You are responsible for activity under your account.
You agree not to:
- Share your account or subscription credentials with others
- Copy, scrape, redistribute, or commercially exploit our content without permission
- Attempt to reverse engineer, disrupt, or overload the Service
- Use the Service for any unlawful purpose or in a way that harms other users
- Upload content that is unlawful, infringing, or abusive
We may suspend or terminate access if we reasonably believe you have breached these Terms or misused the Service.
5. Trials, subscriptions, billing, and cancellation
Some features may be offered on a free or paid trial. Trial length and inclusions are shown at sign-up or checkout. When a trial ends, paid access continues only if you have an active paid subscription.
Paid plans are sold as subscriptions or packs as described at checkout. Prices, billing intervals, and what is included are shown before you pay. Unless stated otherwise, subscriptions renew automatically at the then-current price until you cancel.
You can cancel a subscription at any time. After cancellation, you keep access until the end of your current paid billing period. We do not provide mid-period refunds for the unused portion of a period once your cooling-off rights (section 6) no longer apply, except where required by law or where we agree otherwise in writing.
Payments are processed by Stripe or another payment provider we appoint. You authorise us and our payment provider to charge your selected payment method for amounts due.
6. Cooling-off and refunds
If you are a consumer in the UK (or elsewhere where equivalent rights apply) and buy digital content or online services at a distance, you generally have a statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
For digital content not supplied on a tangible medium, that cancellation right ends once supply of the digital content begins, if you requested immediate access and acknowledged that you would lose the right to cancel once supply started. By starting a paid subscription or unlocking paid digital content during the 14-day period, you request that supply and acknowledge that loss of the cancellation right once supply begins.
If you are still within your cooling-off period and have not lost the right to cancel as described above, contact us at graeme@gmatpanda.com to cancel and request a refund. After that period (or after the right ends as above), cancellation works as in section 5: access continues to the end of the paid period, without a mid-period refund, unless the law requires otherwise.
Nothing in these Terms affects your mandatory rights under the Consumer Rights Act 2015 or other non-excludable consumer law.
7. Intellectual property
We (and our licensors) own the Service, including software, branding, questions, explanations, method cards, and other materials. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal study while your account is entitled to access.
You may not copy, modify, publish, sell, or create derivative works from our content except as allowed by these Terms or by law.
8. Third-party services
The Service may rely on third parties (for example payment processing, analytics, hosting, or AI providers). Their terms and privacy practices apply to their services. We are not responsible for third-party sites or services we do not control.
9. Disclaimer of warranties
Subject to your non-excludable rights under the Consumer Rights Act 2015 and other applicable law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet every study goal. Exam content and scoring practices can change; you remain responsible for checking official GMAT requirements.
10. Limitation of liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law (including mandatory consumer rights).
Subject to the paragraph above, we are not liable for loss of profits, loss of data, loss of opportunity (including exam scores or admissions), or other indirect or consequential loss, whether arising in contract, tort (including negligence), or otherwise, to the extent permitted by law.
Subject to the same carve-outs, our total liability to you for all claims arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the amounts you paid us for the Service in that period, and (b) £100.
11. Privacy
How we handle personal data is described in our Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will change when we do. If a change is material, we will take reasonable steps to notify you (for example by email or an in-product notice). Continued use of the Service after the updated Terms take effect means you accept the updated Terms, except where applicable law requires a different process.
13. Governing law and contact
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your local courts where mandatory rules allow.
